Terms of Service

1. The service

StatsNGraphs provides a hosted web analytics platform. We offer a free tier and paid plans. Features and limits for each plan are described at /features and on the pricing page. We reserve the right to modify, add, or remove features at any time with reasonable notice.

2. Your account

• You must provide a valid email address to create an account.
• You are responsible for all activity that occurs under your account.
• You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the service.
• You may not share your account credentials or allow multiple people to share a single account.
• You may delete your account at any time from the Account settings page.

3. Acceptable use

You agree not to:

• Use the service for any unlawful purpose or in violation of any applicable law or regulation.
• Track websites or collect data without the knowledge or consent of those sites' users where required by law.
• Attempt to gain unauthorized access to our systems, other accounts, or any related infrastructure.
• Transmit malware, spam, or any harmful code through the service.
• Resell, sublicense, or white-label the service without our written permission.
• Use the service in a way that could damage, disable, or impair it for other users.
• Circumvent or attempt to circumvent any rate limits, plan quotas, or security measures.

We may suspend or terminate accounts that violate these rules without notice.

4. Your data and content

You retain ownership of all analytics data and configurations you create in StatsNGraphs. You grant us a limited license to store and process that data solely to provide the service to you.

You are responsible for ensuring your use of the tracking snippet complies with applicable privacy laws (e.g. GDPR, CCPA) in the jurisdictions where your website operates. We act as a data processor on your behalf for visitor data.

5. Billing and payments

• Paid plans are billed on a monthly or annual basis as selected at checkout.
• All payments are processed by Lemon Squeezy. By purchasing a plan, you also agree to Lemon Squeezy's terms.
• Subscriptions renew automatically unless cancelled before the renewal date.
• You may cancel your subscription at any time; you will retain access to paid features until the end of the current billing period.
• We do not offer refunds for partial billing periods, except where required by applicable consumer protection law.
• We reserve the right to change pricing with at least 30 days' notice to active subscribers.

6. Service availability

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or emergency fixes that cause temporary downtime. We are not liable for any losses arising from downtime or service interruptions.

7. Disclaimer of warranties

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be error-free, secure, or continuously available.

8. Limitation of liability

To the maximum extent permitted by law, Side Quest Creative, Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or in connection with your use of the service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

Either party may terminate the agreement at any time. We may suspend or terminate your access immediately if you violate these Terms. Upon termination, your right to use the service ceases and we will delete your data in accordance with our Privacy Policy.

10. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page with a revised effective date. For material changes, we will notify account holders by email at least 14 days in advance. Continued use of the service after changes take effect constitutes acceptance of the new Terms.

11. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.
